Terms of Service

These Terms govern your access to and use of Fitimio, including the website, dashboard, MCP server, subscription features, and integrations with AI assistants.

This document should be reviewed for the final operating entity and jurisdiction before launch.

1. Operator

Fitimio is operated by the person or legal entity identified in the account, checkout, invoice, or order confirmation for the service.

2. What Fitimio is

Fitimio is a diet, workout, health metric, shopping list, and personal wellness tracking product. It can expose your Fitimio data to AI assistants through MCP tools when you connect an assistant.

Fitimio provides data storage, tracking, and tool access. Connected AI assistants may generate responses based on data requested from Fitimio.

3. No medical advice

Fitimio is not a healthcare provider, medical device, emergency service, or substitute for professional medical advice.

Fitimio does not diagnose, treat, prevent, or cure disease. It does not replace a doctor, registered dietitian, mental health professional, pharmacist, or emergency service.

You are responsible for consulting a qualified professional before making health, diet, medication, allergy, pregnancy, eating disorder, or condition-related decisions.

4. Your account

You must provide accurate account information and keep your login credentials secure.

You are responsible for activity under your account, including MCP connections and assistant integrations you enable.

You must not share account access, bypass security controls, abuse the MCP server, scrape data, interfere with the service, or use Fitimio for unlawful purposes.

5. Connected AI assistants

When you connect Fitimio to an AI assistant, the assistant may call Fitimio tools to read data or perform actions.

Fitimio does not control every message, output, or decision generated by external AI assistants. The AI provider may have its own terms, privacy policy, safety systems, data processing rules, and account controls.

You are responsible for reviewing and accepting the terms of any AI provider you connect.

6. Health data and consent

Some Fitimio features involve diet, health, allergy, condition, workout, and wellness data. You must provide explicit consent where required before using those features.

You can withdraw consent, but doing so may disable features that require health or wellness data.

7. User content and data

You retain ownership of the data and content you enter into Fitimio.

You grant Fitimio the limited rights needed to host, process, display, analyze, and transmit your data as necessary to provide the service, including MCP tool responses to assistants you connect.

You must not upload illegal, harmful, infringing, or abusive content.

8. Subscriptions and billing

Paid features require an active subscription unless a trial, promotion, or free access period applies. Billing is processed by Stripe or another payment provider.

Subscriptions may renew automatically unless cancelled before the renewal date shown in your account or in the payment provider's billing portal.

You can manage or cancel your subscription through the Fitimio profile page, which opens the Stripe billing portal. If you cancel, your paid access may continue until the end of the current billing period unless Stripe or applicable law provides otherwise.

Prices, billing intervals, plan limits, and features may change. If required by law, we will provide notice before material subscription changes.

Unless required by law or stated otherwise in the refund policy, fees are non-refundable after the paid period starts. The current refund and cancellation policy is available at /refund-policy.

If a payment fails, Fitimio may keep Premium access available during Stripe's payment retry or grace period. Premium access ends when the subscription becomes unpaid, incomplete, expired, canceled, or otherwise inactive.

9. Acceptable use

You must not use Fitimio to:

• provide or request emergency medical instructions;
• promote self-harm, eating disorder behavior, or dangerous restriction;
• attempt to diagnose or treat another person without qualification;
• reverse engineer, overload, attack, or disrupt the service;
• access another user's data;
• violate applicable law or third-party rights.

10. Service changes and availability

We may modify, suspend, or discontinue parts of Fitimio. We try to keep the service reliable, but we do not guarantee uninterrupted availability.

11. Disclaimers

Fitimio is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

We do not guarantee that nutrition estimates, barcode data, AI outputs, workout plans, or analytics are accurate, complete, safe, or appropriate for your personal medical situation.

12. Limitation of liability

To the maximum extent permitted by law, Fitimio and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business.

Nothing in these Terms limits liability where it cannot legally be limited.

13. Termination

You may stop using Fitimio at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay, or use the service unlawfully.

14. Governing law

These Terms are governed by the laws applicable to the Fitimio operator identified in the checkout or invoice, unless mandatory consumer protection laws require otherwise.
